Cinder by Loft Industries · Last updated October 20, 2026 (draft)
These Terms govern use of Cinder, a fleet operations app provided by Loft Industries, Alabama, United States. By creating or using an account you agree to them. If you accept on behalf of a company, you confirm you may bind that company (the "Customer").
Cinder is offered only to businesses operating in the United States and their authorized workers, aged 18 or older. Customers decide who gets an account and are responsible for their users.
Keep your username and password private. You are responsible for activity under your account. Tell us right away at security@cindertransport.com if you suspect unauthorized use. We may sign out idle sessions or suspend accounts to protect security.
Enter accurate records. Cinder is a tool to help keep records; the Customer and its drivers remain responsible for compliance with all laws, including federal and state hours of service, inspection, licensing and safety rules. Do not use Cinder while driving in a way that breaks the law or is unsafe. Do not misuse Cinder: no unlawful content, no attempts to break security, reverse engineer, overload, scrape or resell the service.
Unless we state in writing that a specific version is registered as an electronic logging device, Cinder is not represented as a registered ELD, and its hours calculations are informational. Always check results against the regulations.
The Customer owns the data it and its users put into Cinder. The Customer gives us permission to host, process and display it to provide and support Cinder, as described in our Privacy Policy. We do not sell Customer data.
Paid plans are billed as shown when you subscribe or in a written order. Fees are non-refundable except where the law requires or we say otherwise in writing. We may change prices with at least 30 days' notice for the next billing period.
Either party may end the subscription as the plan allows. We may suspend or end access for non-payment or a serious breach. After the subscription ends, the Customer has 90 days to export its data, after which we permanently delete it, except where the law requires us to keep it.
We work to keep Cinder available but do not promise it will be uninterrupted or error-free. We may update features. If we remove a major feature a paying Customer relies on, we will give reasonable notice.
Cinder is provided "as is" and "as available." To the fullest extent allowed by law, Loft Industries disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent allowed by law, Loft Industries will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, fines, penalties or lost data. Our total liability for any claim is limited to the amount the Customer paid us for Cinder in the 12 months before the claim.
The Customer will defend and indemnify Loft Industries against third-party claims arising from the Customer's data, its users' conduct, or its breach of these Terms or the law.
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law rules. Disputes will be brought in the state or federal courts located in Alabama, and both parties consent to that venue.
Our Privacy Policy and End User License Agreement are part of these Terms. If any part is unenforceable, the rest remains in effect. We may update these Terms by posting changes and notifying Customers of material changes; continued use after the effective date means acceptance.
